The Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (Public Law 104-193) made significant changes in eligibility requirements for legally admitted aliens in the Food Stamp Program. The eligibility requirements for Food Stamps for aliens are located in Section 1240-1-3-.12-(1).


Each household memberís U.S. citizenship or alien status must be acknowledged at the time of application and at each recertification. This is done by signing the application form, HS-0169. The application form has a line for each individualís status to be marked. The individual who completes the application form affirms that all persons applying for or receiving assistance are United States citizens or aliens in satisfactory immigration status.
