DETERMINING GOOD CAUSE

When a mandatory Food Stamp E&T registrant fails to comply with his/her work requirement, a notice of adverse action should be sent informing the individual of the penalty for non-compliance. The caseworker must contact the household and determine whether good cause exists. Good cause for failure to comply includes circumstances beyond the household member’s control, such as, but not limited to: (e) an individual cannot make satisfactory progress in an education program according to the ABE teacher and does not appear capable of earning an acceptable wage. The notice of adverse action
must contain the specific act of non-compliance the individual committed and
the proposed period of disqualification.
The individual must also be told that they can re-apply after the disqualification
period is over. The notice must be
sent even if the disqualification begins after the certification period has
expired and the household has not been recertified.
