NON-COMPLIANCE WITH WORK REQUIREMENTS IN CASH ASSISTANCE |

When a person in a Food Stamp E&T county who is exempt from the Food Stamp work requirement because of participation in a Cash Assistance work component or unemployment compensation work requirement fails to comply with the Cash Assistance work requirements, the caseworker must evaluate the individual for Food Stamp E&T. If the person is not otherwise exempt from the Food Stamp E&T requirement, then he/she is non-compliant and must be sanctioned. If the participant fails to comply with the Cash Assistance requirement and does not meet an exemption in the Food Stamp E&T Program, the participant will be sanctioned and removed from the budget in the Food Stamp Program. A 10% penalty would not be applied when the sanction applies. If the individual fails to comply with a Cash Assistance work requirement but the individual does not have a Food Stamp work requirement, he/she is not subject to a Food Stamp sanction. However, since the individual did fail to comply with the Cash Assistance requirement, the Food Stamp allotment will be reduced by 10% as a penalty. The Cash Assistance household who does not comply with work will never have both a Food Stamp sanction and a Food Stamp 10% penalty. If the individual is exempt from work requirements or residing in a non-E&T county for Food Stamps, apply the 10% penalty to the Food Stamp allotment. If the individual is not exempt from work in the Food Stamp program and lives in an E&T county, apply the Food Stamp work requirement penalty, disqualifying the individual. |
